Trailer Hire Terms and Conditions

These Trailer Hire Terms and Conditions (Trailer Hire Terms) apply to the hire of trailers (Trailer) listed on our Platform by third- party owners (Trailer Owners) and hired by users (Hirers).

These Terms were last updated on 8 July 2026.

These Trailer Hire Terms are supplementary to, and must be read together with, our general Terms and Conditions, available at Local Hire Marketplace T&C’s (General Terms). In the event of any inconsistency between these Trailer Hire Terms and the General Terms, these Trailer Hire Terms will prevail to the extent of the inconsistency.

In these Terms, when we say you or your, we mean both you and any entity you are authorised to represent (such as your employer). When we say Local Hire Marketplace, we, us, or our, we mean Local General Hire Pty Ltd t/a Local Hire Marketplace (ABN 73 692 128 537). These Terms apply to Hirers and Trailer Owners equally

Capitalised words used but not defined in these Trailer Hire Terms have the meaning given to them in the General Terms.

OUR DISCLOSURES

Please read these Trailer Hire Terms carefully before you accept. We draw your attention to:

  • clause 1 (Application and Platform) which makes clear that Local Hire Marketplace operates as a marketplace only and is not a party to any hire transaction between a Trailer Owner and a Hirer.

  • clause 2 (Authorised Drivers and Licence Requirements) which sets out who may tow a Trailer; clauses 3 to 6 which sets out the Hirer’s general obligations and responsibilities in connection with hiring the Trailer;

  • clause 7 (Insurance) which makes clear that no insurance or damage cover is provided under these Trailer Terms and that Hirers use the Trailer entirely at their own risk; and

  • clause 10 (Liability) which sets out exclusions and limitations to our liability in connection with Trailer hire.

These Trailer Hire Terms do not intend to limit your rights and remedies at law, including any of your Consumer Law Rights.

1. Application and Platform

1.1 These Trailer Hire Terms apply to any Hire Booking made through our Platform that involves the hire of a Trailer in addition to the General Terms.

1.2 We are a marketplace platform only. We are not a party to any hire transaction between a Trailer Owner and a Hirer, and we do not own, operate, maintain or inspect any Trailer listed on our Platform. We provide the Platform as a means for Trailer Owners and Hirers to connect. Our obligations to you are limited to providing access to our Platform in accordance with the General Terms

1.3 The hire of a Trailer is a transaction solely between the Trailer Owner and the Hirer. The terms of that transaction are governed by the Hire Agreement between the Trailer Owner and the Hirer, together with any additional terms and conditions set out in the relevant Equipment Listing.

2. Authorised Drivers and Licence Requirements

2.1 The Trailer may only be towed by the Hirer or a person expressly authorised by the Hirer and disclosed to the Trailer Owner at the time of the Hire Booking (Authorised Driver).

1.2 The Hirer agrees that the Hirer and any Authorised Driver must:

(a) be at least 21 years of age;

(b) hold a valid driver's licence issued in an Australian state or territory that is not subject to any restriction or condition that would prevent them from lawfully towing the Trailer; and

(b) hold current and valid vehicle registration for the towing vehicle.

1.3 The Hirer agrees that the Trailer must not be towed by:

(a) a learner driver or a provisional or probationary licence holder;

(b) any person whose driver's licence is cancelled, suspended or subject to any demerit-related restriction; or

(b) any person who has provided false or misleading information regarding their name, age, address or driver's licence details.

3. Hirer Obligations

3.1 During the Hire Period, the Hirer agrees to (and to the extent applicable, ensure the Authorised Driver agrees to) at all times:

(a) comply with the terms of the Hire Agreement and any operating instructions or conditions provided by the Trailer Owner;

(b) comply with all applicable laws, road rules and regulations relating to the towing and use of the Trailer; and

(C) use the Trailer only for personal domestic purposes and not for any commercial purpose.

3.2 The Hirer agrees to notify the Trailer Owner immediately via the Platform's messaging system if the Trailer develops any fault, is involved in an accident, or is lost or stolen during the Hire Period.

3.4 The Hirer and any Authorised Driver agrees to not:

(a) damage the Trailer deliberately or recklessly, or allow anyone else to do so;

(b) modify the Trailer in any way;

(C) allow any person to repair, work on, tow or salvage the Trailer without the prior written consent of the Trailer Owner; or

(D) sell, sublease or otherwise dispose of the Trailer, or register or claim any interest in the Trailer under the Personal Property Securities Act 2009 (Cth).

3.5 The Hirer and any Authorised Driver are responsible for all fines, penalties, traffic infringements, tolls and associated costs incurred during the Hire Period. Any challenge to such fines or notices is at the Hirer's own cost.

4. Unauthorised Use

(a) any illegal purpose;

(b) any experimental or demonstrational purpose; or

(C) any purpose where the trailer lights are not fully operational.

4.2 The Hirer agrees that the Trailer must not be loaded with:

(a) any dangerous, hazardous or flammable materials;

(b) any illegal substances; or

(C) any load that exceeds the limits stated on the Trailer's compliance plate.

4.3 The Hirer agrees that the Trailer must not be towed on:

(a) unsealed roads;

(b) roads designated for off-road vehicles only;

(C) flooded roads, beaches, creeks, streams, dams or areas prone to flooding;

(d) closed roads or roads otherwise unsuitable for trailers; or

(e) any road or area displaying a no-trespassing sign or that the Authorised Driver otherwise has no legal basis to enter or occupy.

5. Tow Vehicle

5.1 The Hirer agrees that the Trailer must not be used for any of the following unauthorised purposes:The Hirer must ensure any vehicle used to tow the Trailer is properly equipped to do so. Prior to towing, the Hirer must confirm that the

(a) vehicle’s towing capacity is suitable for the combined weight of the Trailer and its load;

(b) tow bar capacity is suitable for the combined weight of the Trailer and its load; and

(C) tow plug is compatible with the Trailer’s plug and is in working condition.

6. Care and responsibility

6.1 The Hirer and any Authorised Driver must take reasonable care of the Trailer throughout the Hire Period. This includes:

(a) taking reasonable steps to protect the Trailer from adverse weather conditions and weather events;

(b) checking and maintaining tyre pressures, including the spare tyre if fitted;

(C) not overloading the Trailer beyond the weight limits stated on the compliance plate;

(d) ensuring all items are loaded entirely within the Trailer's dimensions and do not protrude beyond the sides, front or rear of the Trailer unless appropriately secured and marked in accordance with applicable road regulations;ot overloading the Trailer beyond the weight limits stated on the compliance plate;

(e) securing the Trailer against theft when stored or parked;

(f) not using the Trailer if it is unsafe, damaged or unroadworthy; and

(g) complying with any instructions provided by the Trailer Owner

7. Insurance

7.1 No insurance or damage cover of any kind is included in or provided under these Trailer Hire Terms or the General Terms in connection with the hire of a Trailer. The Hirer uses the Trailer entirely at their own risk.

7.2 We strongly recommend that the Hirer obtain their own insurance cover prior to the commencement of the Hire Period, including cover for damage to the Trailer and any third-party loss or liability arising from the Hirer's use of the Trailer. The Hirer should check with their motor vehicle insurer as to whether the Trailer is covered under their existing policy.

7.3 Trailer Owners agree to, at a minimum, maintain appropriate insurance to cover theft and loss of the Trailer. We may request evidence of such insurance cover at any time

8. Damage and Loss

8.1 The Hirer is responsible for the Trailer Owner's reasonable costs of any repairs to, or replacement of, the Trailer arising from the Hirer's improper or negligent use of the Trailer, or where loss, theft, damage or destruction occurs during the Hire Period while the Hirer is responsible for the risk in the Trailer. Such costs will be a debt due and immediately payable to the Trailer Owner.

8.3 The Hirer is not responsible for damage to the Trailer that constitutes fair wear and tear.

8.4 We are not responsible for any damage to the Hirer's property, the Trailer Owner's property or the property of any third party resulting from the Hirer's use of the Trailer.

9. Photographs and Handover

9.1 The Hirer agrees to collect the trailer at the collection location and the date and time agreed with the Trailer Owner in the Hire Booking.

9.2 At the time of handover, the Trailer Owner and the Hirer are each responsible for satisfying themselves as to the condition and roadworthiness of the Trailer. The Trailer Owner and the Hirer should, at a minimum:

(a) inspect the Trailer and note any existing damage or defects;

(b) verify that all trailer lights are operational and functioning correctly in conjunction with the towing vehicle; and

(C) verify the identity and licence details of the Hirer and any Authorised Driver.

9.3 Neither party is obliged to proceed with the hire if they are not satisfied with the condition of the Trailer or the identity of the Hirer or Authorised Driver.

9.4 The Hirer and the Trailer Owner agree to each take clear, high-resolution digital photographs of the Trailer immediately before and after the Hire Period, including photographs of the front, rear, sides, each wheel of the Trailer, VIN plate, drawbar, tow coupling and the vehicle coupled to the Trailer on collection, and retain such photographs for a reasonable period thereafter. If a dispute arises, the parties may use such photographs for the purpose of resolving the dispute at their discretion.

9.5 The Hirer agrees to return the Trailer to the Trailer Owner at the agreed return location, date and time agreed with the Trailer Owner in the Hire Booking, in the same condition as at the commencement of the Hire Period, subject to fair wear and tear.

9.6 The Hirer and the Trailer Owner acknowledge that the steps set out in this clause 9 are matters solely between the Trailer Owner and the Hirer. We are not a party to, and take no responsibility for, the handover process or the condition of the Trailer at the time of collection or return. We do not mediate, adjudicate or otherwise involve ourselves in any dispute between a Trailer Owner and a Hirer arising from or in connection with the condition of the Trailer, and we have no liability to either party in connection with any such dispute.

10. Liability

10.1 To the maximum extent permitted by law, we will not be liable for, and you release us from liability for, any loss or damage caused or contributed to by, arising from or in connection with

(a) the condition, roadworthiness, registration or safety of any Trailer listed on our Platform;

(b) any information or content provided by a Trailer Owner in an Equipment Listing;

(C) any property damage, death or personal injury arising from or in connection with the Hirer's use of the Trailerverify the identity and licence details of the Hirer and any Authorised Driver.

(d) any loss of or damage to goods or property carried in the Trailer, whether owned by the Hirer or a third party; or

(e) any failure by a Trailer Owner to honour the terms of a Hire Agreement or these Trailer Hire Terms.

10.2 Neither party is obliged to proceed with the hire if they are not satisfied with the condition of the Trailer or the identity of the Hirer or Authorised Driver.

10.3 Nothing in these Trailer Hire Terms limits your Consumer Law Rights.

11. Trailer Owner Obligations

11.1 By listing a Trailer on our Platform, the Trailer Owner confirms that:

(a) they are the registered owner of the Trailer or are otherwise legally entitled to hire it out;

(b) the Trailer is roadworthy, currently registered and in a safe condition at the commencement of each Hire Period;

(C) the Equipment Listing contains an accurate and complete description of the Trailer, including any specific conditions of hire; and

(d) the Trailer clearly displays its manufacturer’s compliance plate and all load limit markings are in a legible condition at the commencement of each Hire Period

11.2 Trailer Owners agree to indemnify us and hold us harmless against any liability we suffer or incur arising out of or in connection with their failure to comply with clause 9.1, including any claim by a Hirer, third party or regulatory authority

12. Definitions

In these Trailer Hire Terms:

Authorised Driver has the meaning given in clause 2.1.

General Terms means the Local Hire Marketplace Terms and Conditions, as amended from time to time.

Hire Period has the meaning given in the General Terms.

Trailer means a non-motorised vehicle designed to be towed by a motor vehicle, as described in the relevant Equipment Listing.

Trailer Owner means an Owner (as defined in the General Terms) who lists a Trailer on our Platform for hire.

Trailer Hire Terms means these Trailer Hire Terms and Conditions.
